This “Privacy Policy on Personal Data Protection” shall apply to all databases containing personal data that are processed by INCALPACA S.A. (hereinafter INCALPACA), a company identified according to the following information:

At INCALPACA we are committed to the protection of personal data, as well as to the respect of personal privacy. Based on this, and in strict compliance with the applicable legal provisions, INCALPACA makes available to interested parties this Privacy Policy, which specifically details all aspects related to the processing of personal data by INCALPACA.
3. REGARDING THE PROCESSING OF PERSONAL DATA - “CUSTOMER” DATABASE
3.1 REGISTRATION OF THE DATABANK
INCALPACA is the owner of the database called “Customers”, registered in the National Register of Personal Data Protection with registration code RNPDP-PJP N° 3174, in which the personal data provided by the subjects as customers will be stored.
3.2 PURPOSES OF THE PROCESSING
INCALPACA will process personal data for the following purpose:
- To execute, manage and administer the business relationship.
3.3 PERSONAL DATA COLLECTED
Names and surnames, type and number of identity document, RUC, address (in case of shipments), e-mail, telephone.
3.4 MANDATORY PERSONAL DATA
In order to carry out the purposes described in point 3.2, it is mandatory that you provide us with the data indicated in point 3.3.
3.5 CONSEQUENCES OF NOT PROVIDING THE DATA OR YOUR REFUSAL TO DO SO
Failure to provide the mandatory data set forth in point 3.3 will prevent us from carrying out the purpose described in point 3.2.
3.6 RECIPIENTS AND TRANSFER OF PERSONAL DATA
INCALPACA may transfer personal data within the national territory and abroad, by any means, to companies of the corporate group, related legal entities, service providers whether natural or legal persons, in order to comply with the purposes referred to in point 3.2.

The data will be kept during the execution of the commercial relationship, and for a period of five (5) years after its completion.

INCALPACA is the owner of the "Marketing-Advertising" database, registered in the National Register of Personal Data Protection with registration code RNPDP-PJP N° 3175, in which the personal data provided by the interested parties will be stored.
4.2 PURPOSES OF THE PROCESSING
INCALPACA will process the personal data in accordance with the following purpose:
- To send advertising information regarding our products, services, promotions and offers.
4.3 PERSONAL DATA COLLECTED
INCALPACA will collect the following personal data: names and surnames, type and number of identity document, telephone, address, e-mail, day and month of birthday.
4.4 MANDATORY PERSONAL DATA
In order to carry out the purpose described in point 4.2, it is mandatory that you provide us with the data required in point 4.3.
4.5 CONSEQUENCES OF FAILURE TO PROVIDE THE DATA OR YOUR REFUSAL TO DO SO
Failure to provide the mandatory data set forth in point 4.3 will prevent us from carrying out the purpose described in point 4.2.

The data will be kept until your consent is revoked.
5. REGARDING THE PROCESSING OF PERSONAL DATA – “JOB APPLICANTS” DATA BANK
5.1 DATA BANK REGISTRATION
INCALPACA is the owner of the database called "Job Applicants", registered in the National Register of Personal Data Protection with registration code RNPDP-PJP N° 30913, in which the personal data provided by applicants will be stored.
5.2 PURPOSES OF THE PROCESSING
INCALPACA will process the personal data according to the following purpose:
- To collect the personal data of the applicants in order to manage the personnel selection processes.
5.3 PERSONAL DATA COLLECTED
INCALPACA will collect the following personal data: Names and surnames, ID number, home address, telephone number, e-mail address, image, date of birth, gender, profession, age, academic data, contact person data.
5.4 MANDATORY PERSONAL DATA
In order to carry out the purposes described in point 5.2, it is mandatory to provide us with the data indicated in point 5.3.
5.5 CONSEQUENCES OF NOT PROVIDING THE DATA OR YOUR REFUSAL TO DO SO
Failure to provide the mandatory data indicated in point 5.3 will prevent us from carrying out the purposes described in point 5.2.
5.6 RECIPIENTS AND TRANSFER

Personal data will be kept during the selection process to which you are applying, or for a maximum period of three (3) months. The retention period for personal data will be two (2) years from the authorization granted by the applicant, when they are submitted outside of a selection process.
6. REGARDING THE PROCESSING OF PERSONAL DATA - “COMPLAINTS AND GRIEVANCES” DATABASE
6.1 DATA BANK REGISTRATION
INCALPACA, is the owner of the data bank called "Complaints and Grievances", registered in the National Register of Personal Data Protection with registration code RNPDP-PJP N° 30912, in which the personal data provided by the subjects who submit a complaint or grievance will be stored.
6.2 PURPOSES OF THE TREATMENT
INCALPACA will treat the personal data according to the following purposes:
- To respond to the complaint or grievance that may be submitted by any person.
- To comply with the provisions of the Consumer Protection Code, the Complaint Book Regulations and other applicable regulations.
6.3 DATA COLLECTED
INCALPACA will collect the following personal data: names and surnames, type and number of identity document, home address, telephone number, e-mail, signature, age, legal representative´s data (in the case of minors).
6.4 MANDATORY DATA
In order to carry out the purposes described in point 6.2, it will be mandatory that you provide us with the data stated in point 6.3.
6.5 CONSEQUENCES OF NOT PROVIDING THE DATA OR YOUR REFUSAL TO DO SO
Failure to provide the mandatory data indicated in point 6.3 will prevent us from carrying out the purposes described in point 6.2.
6.6 RECIPIENTS AND TRANSFER OF PERSONAL DATA
INCALPACA will not transfer your personal data, except as expressly provided by law.
6.7 ABOUT AUTOMATED DECISIONS REGARDING YOUR PERSONAL DATA
INCALPACA will not submit your personal data to any type of automated decision.
6.8 CONSERVATION PERIOD
Personal data will be processed for as long as necessary to fulfill the purposes described above and for a maximum period of two (02) years from the date of submission of the complaint or grievance.
7. REGARDING THE PROCESSING OF PERSONAL DATA - “VIDEO SURVEILLANCE” DATABASE
7.1 DATA BANK REGISTRATION
INCALPACA, is the owner of the data bank called "Video Surveillance", registered in the National Register of Personal Data Protection with registration code RNPDP-PJP N° 30911, in which the personal data provided through the video surveillance system will be stored.
7.2 PURPOSES OF THE PROCESSING
INCALPACA will treat the personal data according to the following purposes:
- To provide security in offices, branches and stores.
- To carry out labor control.
7.3 PERSONAL DATA COLLECTED
INCALPACA will collect the following personal data: image.
7.4 MANDATORY PERSONAL DATA
In order to carry out the purposes described in point 7.2, it will be mandatory that you provide us with the data stated in point 7.3.
7.5 CONSEQUENCES OF FAILURE TO PROVIDE THE DATA OR YOUR REFUSAL TO DO SO
Failure to provide the mandatory data indicated in point 7.3 will prevent us from carrying out the purposes described in point 7.2.

7.8 CONSERVATION PERIOD
Personal data will be kept for a maximum of sixty (60) days. However, if the personal data collected revealed the commission of alleged labor violations and/or work accidents, it will be kept for a period of one hundred and twenty (120) days from the date of its discovery.
8. EXERCISE OF ARCO RIGHTS
For all the purposes indicated in this privacy policy, you may exercise your rights of access, rectification, cancellation and opposition, via email: derechosarco@incalpaca.com or at our offices located at the address indicated in point 1 of this policy. In addition to the aforementioned rights, you will have the right to withdraw the consent granted at any time through the procedure described in the preceding paragraph, without such act affecting the lawfulness of the processing carried out prior to the withdrawal of your consent. 9. CHANGES IN THE PRIVACY POLICY
INCALPACA reserves the right to make changes, adjustments or updates to this privacy policy at any time, in order to comply with new legal, regulatory, jurisprudential or internal policies adopted.
